Flop Turn River Society Membership Terms & Conditions
1. Nature of Organization
Flop Turn River Society (“FTR Society,” “we,” “us,” “our”) is a membership-based community offering access to poker-themed events and travel opportunities. We do not own, operate, or control any cruise line, airline, hotel, casino, excursion company, or other service provider. Membership provides access to opportunities only. All travel, accommodations, excursions, tournaments, gambling, and entertainment are provided by independent third-party suppliers.
2. No Agency Relationship
All suppliers are independent contractors and are not employees, agents, or representatives of FTR Society. We make no warranty or representation about the standard of services offered by any supplier. You release us from any claim arising from the acts, omissions, negligence, breach of contract, or misconduct of any supplier.
3. Assumption of Risk & Waiver of Claims
By joining or participating, you acknowledge that: - Travel and gaming activities involve inherent risks, including illness, injury, death, property damage, theft, financial loss, accidents, delays, terrorism, pandemics, natural disasters, and government actions. - You voluntarily assume all risks and agree to release FTR Society from any liability. - You waive any and all claims against FTR Society, whether in contract, tort, equity, statute, or otherwise, even if caused by negligence (except gross negligence or intentional misconduct as limited by law).
4. Gambling & Tournament Disclaimer
FTR Society does not conduct, regulate, or operate gambling. All gaming activities are provided by licensed third parties. You are solely responsible for ensuring compliance with all applicable gambling laws in your jurisdiction. All gambling decisions, wagers, and investments are at your own risk. Losses are final and unrecoverable.
5. Financial Responsibility
You are solely responsible for all costs, including membership fees, travel, accommodations, excursions, medical care, insurance, food, beverages, gratuities, and gambling. FTR Society provides no refunds under any circumstances, including cancellation, delay,
illness, dissatisfaction, or force majeure. All payments are final, non-refundable, and non-transferable.
6. Force Majeure
FTR Society shall not be held liable for any delay, cancellation, or inability to perform due to circumstances beyond its reasonable control, including acts of God, natural disasters, fire, flood, pandemics, strikes, lockouts, terrorism, war, political unrest, sanctions, governmental orders, or supplier insolvency.
7. Limitation of Liability
To the fullest extent allowed by law: - FTR Society shall not be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages. - Liability, if any, shall be strictly limited to the amount paid for membership dues. - No action may be brought against FTR Society more than one year after the cause of action arose.
8. Indemnification
You agree to indemnify, defend, and hold harmless FTR Society, its officers, directors, members, employees, and contractors from any claim, demand, loss, liability, damages, costs, or expenses (including attorney fees) arising from: - Your participation in any event or cruise; - Your gambling, wagers, or financial decisions; - Your acts, omissions, or failure to comply with laws; - Any breach of these Terms & Conditions.
9. Health, Insurance & Fitness to Travel
You certify you are physically and mentally fit to participate in travel and poker events. You are solely responsible for obtaining medical, health, accident, and travel insurance. You must comply with all medical, vaccination, passport, visa, and entry requirements. FTR Society does not provide or guarantee medical care, evacuation, or reimbursement.
10. Code of Conduct & Removal Rights
FTR Society reserves the right to remove or refuse participation to any member or guest who engages in: - Illegal activity; - Excessive intoxication or disorderly conduct; - Harassment, threats, or abuse; - Any action that, in our sole discretion, may endanger others or damage our reputation. No refund will be given if you are removed.
11. Photography, Media & Likeness Release
By attending, you grant FTR Society the irrevocable right to use your name, image, and likeness in photographs, videos, and promotional materials, without compensation.
12. Minors & Guests
All participants must be 21 years of age or older. You are fully responsible for any guest or companion you invite or register.
13. Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of [Insert State]. Any dispute shall be resolved exclusively by binding arbitration under the American Arbitration Association in [Insert City/State]. You waive the right to a jury trial and to participate in class actions.
14. Severability & Entire Agreement
